ConAgra advertised its Parkay Spray Margarine as having "0 grams of fat" and "0 calories." Con Agra bases this statement on an unrealistically small serving size. ConAgra's spray butter actually contains as much fat as regular margarine.
Our lawsuit seeks refunds for all purchasers of the Parkay Spray Margarine since 2009, and an injunction to prevent Con-Agra from continuing to market the products as having "0g fat" or "0 calories."
The court determined that the claims were preempted by federal law and entered summary judgment in favor of the Defendant, Con-Agra.
This lawsuit was filed in 2013. The case was certified as a class action on July 22, 2019. The parties are preparing for trial which is currently scheduled for November 2, 2020.
