On July 1, 2022, Gutride Safier LLP filed a class action lawsuit against Walmart alleging that its Great Value brand ‘recycling’ drawstring bags marketing is false and misleading, in violation of California law. Specifically, the plaintiffs allege that Walmart’s Great Value-brand recycling bags are marketed to package recyclables but themselves cannot be recycled because the bags are made of LPDE plastic. LPDE plastic cannot be recycled and instead end up incinerated, in landfills, or in the environment. Plaintiffs seek to remove the misleading recycling icon and the word ‘Recycling’ from the Great Value-brand drawstring bags. The case, Millam, et al. v. Walmart Inc., was filed in the United States District Court, Central District of California, Case No. 5:22-cv-01090.
