Harley Davidson’s Warranty Restrictions Over Aftermarket Parts

On August 5, 2022, Plaintiff Scott Koller represented by Gutride Safier LLP filed a class action lawsuit against Harley-Davidson for violating state and federal laws. Harley-Davidson threatened consumers with voiding or cancelling their warranties if they didn’t use Harley-Davidson parts or pay for service at their dealerships which come at a price premium. Harley-Davidson’s practices violate the Magnuson-Moss Warranty Act, which makes it illegal to make warranty coverage contingent on dealer service or factory parts.
The case, Koller, et al. v. Harley-Davidson Motor Co. Group LLC, Case No. 4:22-cv-04534 in the Northern District of California, is ongoing.
