False Protein Content Claims on Three Wishes Cereal

On August 19, 2022, Plaintiff Lydia Harville, represented by Gutride Safier LLP, filed a class action lawsuit against Three Wishes Foods, Inc. for its false and misleading protein content claims on the Three Wishes brand cereal. Three Wishes touts that the cereal contains "8g of protein" and “More protein,” but fails to provide the corrected amount of protein on the Nutrition Facts Panel. Further, Three Wishes fails to use the FDA-required Protein Digestibility Corrected Amino Acid score (PDCASS), which indicates the quality of the protein. The Three Wishes cereals mislead consumers into thinking that they are getting a certain amount of protein per serving, when they in fact, are not.
The case, Harville v. Three Wishes Foods, Inc., Case No. 5:22-cv-04774 in the Northern District of California, is ongoing.
