Deceptive ‘100% Biodegradable’ Water Wipes

On October 28, 2022, Gutride Safier LLP filed a class action lawsuit against Water Wipes (USA) Inc.’s for its violation of California law for deceptive trade practices and false advertising and marketing of its wipes as ‘100% biodegradable.’ Plaintiff further alleges that Water Wipes is in violation of the Federal Trade Commission’s Green Guides, which prohibits environmental marketing claims on products which overstate the environmental attribute or benefit of the product. Specifically, the plaintiff alleges that Water Wipes are not biodegradable because the wipes cannot completely break down within a reasonably short period of time after disposal in landfills. Plaintiff seeks to remove the misleading ‘100% biodegradable’ claim from the Water Wipes packaging and recover damages.
