Gutride Safier LLP filed a class against against Van’s International Foods for its false and misleading claims regarding the protein content of its frozen waffles. The complaint contends that Van’s waffles are illegally labeled since they do not contain a percent daily value of protein, which is required by FDA regulations. Furthermore, the protein digestibility score of the wheat and oat proteins used in the waffles is 0.4-0.5, meaning that only 4-5 grams of protein, out of the 10 grams advertised per serving, are actually digestible and usable by the human body, per the complaint.

This case is ongoing.
