Plaintiffs Gillian and Samuel Davidson, represented by Gutride Safier LLP, filed a class action complaint in the Northern District of California against Sprout Foods Inc. in February 2022 regarding Sprout’s labeling and marketing of baby and toddler food products (Davidson v. Sprout Foods Inc., Case No. 4:22-cv-01050). Specifically, the lawsuit concerns products which make unlawful nutrient content claims that mislead purchasers into believing the products are healthier for children than other products. Defendant moved to dismiss the lawsuit. After considering the Motion to Dismiss, Judge Richard Seeborg denied the motion as to the Plaintiffs’ UCL unlawfulness claim and unjust enrichment claim and granted the motion, with leave to amend, as to Plaintiffs' misleading claims.
