Defendant misbrands its baby and toddler food products by making nutrient content claims on the product packages that lead consumers to believe the product is healthier than other products for children under two years of age. Such nutrient content claims are strictly prohibited by the Food and Drug Administration (“FDA”).
Our lawsuit seeks refunds for all purchasers of Sprout baby food pouches. It also seeks an injunction preventing further false advertising.
The case was filed in the United States District Court, Northern District of California on February 19, 2021. Defedant moved to dismiss and Plaintiffs opposed. On July 11, 2022, the Court denied the motion in part and granted Plaintiffs leave to amend.
Who is Covered:
All persons in the State of California who purchased the Products (specific Sprout baby food pouches as outlined in the Complaint) between February 18, 2018 and the present.
