The Allegations:

Consumers are increasingly health conscious and, as a result, many consumers seek foods high in protein to support weight loss, exercise, and general fitness, among other reasons. To capitalize on this trend, Defendant prominently labels its Kodiak Cakes Mixes as containing 14g, 13g, 12g, 10g, or 8g of protein per serving depending on the flavor. In truth, however, the Kodiak Cakes Mixes do not contain the amount of protein that the labels claim.Based on amino acid content testing, the products contain approximately 17% less protein than claimed.

The Results:

This case was resolved and the Plaintiffs voluntarily dismissed their claims.
