The Allegations:

Gerber Products Company deceptively and unlawfully practices labeling and marketing the Gerber brand baby and toddler food products by making nutrient content claims on the product packages. In violation of the Food and Drug Administration's regulations, Gerber's nutrient content claims misleads consumers into believing the products provide physical health benefits for children under two years of age. In fact, the Gerber products are harmful both nutritionally and developmentally for children under two.

Our Goals:

Our lawsuit seeks a temporary and permanent injunction preventing further unlawful, deceptive, fraudulent, and unfair business practices as alleged in the Complaint. It also seeks an award of compensatory, statutory, punitive, and treble damages to be awarded to Plaintiff and other class action members.


The case was filed on August 19, 2022 in the United States District Court, Northern District of California.

Who is Covered:

All persons in the State of California who purchased the Products (outlined in the Class Action Complaint) between August 19, 2018 and the present.
