The Allegations:

Defendant Coty, Inc. markets, advertises, and sells a variety of cosmetic products under the brand names “CoverGirl” and “Rimmel.” The products at issue include foundation cosemtics that have a SPF sun protection claim alongside a claim that the products last 24 or 25 hours. However, SPF protection only lasts two hours so a purchaser would have to reapply the foundation to obtain the advertised SPF benefits. Plaintiff alleges that Defendant's marketing and labeling is false and misleading.

Our Goals:

Our lawsuit seeks refunds for all purchasers of Covergirl and Rimmel cosmetic products that make SPF and 24H/25H duration claims. It also seeks an injunction preventing further misleading and false advertising.

Status:

The case was filed in the United States District Court, Northern District of California on September 16, 2022. Defendant moved to dismiss; Plaintiff opposed. The court has not yet issued an order on the motion to dismiss.

Who is Covered:

All persons in the state of California who purchased the Products between September 16, 2018 and the present.
