Billing Practices Services for Travelers

The Allegations:

Allianz offers insurance for ticket purchases made through ticket sellers (such as Ticketmaster), airlines, and other travel and event-related sites. However, in addition to a "premium," Allianz also charges a fee for a supposed "assistance" service, which Allianz often does not disclose to consumers before their purchases, which is worthless to most consumers, and which is unlawful. Most consumers are not aware that Allianz charges a fee for its supposed assistance service or are being misled about what they are getting for their money.

Our Goals:

Our lawsuit seeks refunds of amounts AGA charged for its supposed assistance service in connection with event ticket insurance and trip insurance. It also seeks an injunction (1) preventing Defendants from charging mandatory and/or undisclosed fees in connection with event ticket insurance and trip insurance purchases; and (2) requiring Defendants to plainly and truthfully disclose all premiums, fees, and charges to consumers prior to their online purchase of insurance.

Status:

The California case was filed on September 4, 2020. Plaintiff successfully defeated Defendant's motion to dismiss the complaint. Discovery has began so that Plaintiff can gather evidence for class certification.

The Washington case was filed on April 4, 2022. Defendant moved to dismiss; that motion is pending.

Who is Covered:

There are two proposed classes in the California case.

The Event Ticket Insurance Class: All natural persons who purchased event ticket insurance policies from Defendants while residing in California at any point from September 4, 2016, until the present, but excluding those persons who used AGA’s assistance services.

The Trip Insurance Class: All natural persons who purchased trip or travel or flight insurance policies from Defendants while residing in California at any point from September 4, 2016, until the present, but excluding those persons who used AGA’s assistance services.

There is one proposed class in the Washington case: All natural persons who, while residing in Washington, purchased travel insurance policies or event ticket insurance policies from Defendants at any point from April 2, 2018, until the present, but excluding those persons who used AGA’s assistance services.
