AT&T International Roaming Charges for Unanswered Calls
This case concerns AT&T's practice of charging international roaming fees for unanswered calls. In many instances, AT&T charges such fees not just once, but twice, for each call. While AT&T touted that international use of its phones is "like using it at home"-where customers are not charged for unanswered calls-it did impose such charges on customers roaming abroad.
AT&T says that the lawsuit cannot proceed, and each disgruntled customer must separately initiate an arbitration. AT&T's arbitration argument has been held unconscionable and unenforceable. But the U.S. Supreme Court is currently hearing AT&T's appeal. A decision is expected in 2011. Meanwhile, this case has been stayed.
